Portugal's E-2 Treaty — Effective March 2024
Portugal became eligible for E-1 and E-2 visas effective March 15, 2024, under Public Law 117-263 enacted December 23, 2022. This is a significant development: Portugal had long been excluded from the E-2 program despite being a stable European economy with strong ties to the United States. Portuguese nationals can now apply for E-2 status at the U.S. Embassy in Lisbon or at any U.S. consulate where they have legal residency.
The Portugal Opportunity — Golden Visa + E-2
Portugal's Golden Visa program — which grants Portuguese residency (and after 5 years, citizenship) in exchange for qualifying investment — has long attracted investors from non-E-2 countries like India, China, and Brazil who sought a European pathway. With Portugal now added to the E-2 treaty, investors who obtained Portuguese citizenship through the Golden Visa program can now apply for E-2 status using their Portuguese passport.
