Treaty Status — The AIT Arrangement
Taiwan's E-2 eligibility is unique in the program. Because the United States does not maintain formal diplomatic relations with Taiwan, E-2 access is provided through the Agreement on Commerce and Trade between the American Institute in Taiwan (AIT) and the Taipei Economic and Cultural Representative Office (TECRO) — effectively the U.S.-Taiwan bilateral commercial relationship. This arrangement has been in place since 1979 and provides the same E-2 benefits as a formal treaty. Taiwanese nationals holding Republic of China passports are eligible.
